Terms and Conditions/Privacy Policy:

RSVPhere.com, LLC. ('RSVPhere' or 'We' or 'Us') operates RSVPhere.com.  We are hosted in the United States and this agreement operates to the fullest extent allowable by law.  The terms of use set forth the legally binding terms for your use with RSVPhere.com.   Your use of RSVPhere.com represents your acceptance of these terms as a visitor or as a member of the site.   As a member you also indicate your acceptance of these terms during the registration process.  If any piece of this agreement is found to be void or unlawful, it will be removed and have no effect on the enforcement of the rest of the policy.  If RSVPhere does not enforce a provision of this document, it does not affect our right to do so.  The section titles are placed for ease of understanding of this policy and have no legal value.

PLEASE READ THIS POLICY CAREFULLY.

 Our privacy policy within refers to the personally identifiable information as well as other forms of data collected on RSVPhere.com given by users voluntarily.  You agree to keep registration information updated and that it is truthful and accurate information you provide.  You are to follow applicable laws and regulations. You agree not to plan harm or to circumvent RSVPhere security services.

Conduct: We will only use information provided to RSVPhere in accordance with this Terms of Agreement/Privacy Policy.  We do not knowingly gather personal information from children under the age of 13.  Users of this site should be over the age of 13, and visitors under the age of 13 should be with the supervision of an adult.  You may not use our services for illegal, pirating, or for offensive purposes.  You may not exploit, harass or post nudity or links to adult sites.  You must abide by intellectual property rules set in place for RSVPhere and any content/links posted through the site with associations to such policies.  Content of gottaRSVP.com may not be duplicated or used, entirely or partially, without the prior written permission of RSVPhere.com.

Also, along with these rules, if you believe there has been a copyright infringement against you at any point, please contact us with details at support@RSVPhere.com .  We reserve the right to remove accounts of members who infringe on copyrights.

Do not solicit information from minors.  Do not use deceptive content.  No chain mail or junk email.  It is harmful to RSVPhere and difficult to quantify for you to send junk email, chain mail, or unsolicited commercial communication with the information you collect during the RSVP process.  Therefore you agree, as a reasonable penalty, to pay RSVPhere $25 per individual that receives junk mail, chain mail, or unsolicited commercial communication from you in conjunction with our services.  As a host of an event, if you are planning on using the information provided from guests for such purposes as mentioned above, you must inform them of the intentions you have prior to their consent to provide such information to you.  Your activity with any third party vendors, including any purchases you make are solely between you and the third party vendor and we make no guarantees and are not liable for anything affiliated with those transactions.

Your participation in any of the events through which you RSVP through our site or other means in any affiliation with our site is at your sole and exclusive risk.  You understand that by attending these events you may be exposed to risks and hazards and that RSVPhere is not responsible or liable for any damages or injuries to you, your heirs or affiliates (including death) including any minors due to traveling to or attending such events. You agree to release claims and waive all liability for these results from events connected to RSVPhere.com.

Changes to Policy: This policy applies to current services offered as well as services that may be offered in the future by RSVPhere.com.  The policy may be revised to keep with updated laws and our company policies, and changes will be considered effective as they are posted on the RSVPhere website.  Your continued use of the site reflects your acceptance of the revised terms.  Please revisit this policy to check for revised terms. We prohibit illegal and/or unauthorized use of RSVPhere.

Warranty: We have no warranties about the content posted through event RSVP pages or other relative pages to those events on our site.  The content that individuals post does not reflect the policies or opinions of RSVPhere.com.  We do not make guarantees on the accuracy of user content and users access third party sites at their own risk.  We do not take any responsibility for the information or goods and services provided by third party vendors.  We also do not make guarantees on results from use of RSVPhere services.

Management: RSVPhere reserves the right to restrict access to or terminate your home profile/events if we feel this policy has been violated or for any other reason we deem necessary without explanation or warning.  We may also remove any information we feel necessary, with or without reason, and without liability.  You agree only to use the usernames and passwords that have been provided to you to access the site or your own personal user name and password created for your account.  Under no circumstances will you pretend or impersonate another person.  You may not set up event pages for others unless you are authorized to do so.

Mobile Services:  Services used through your mobile phone will use your mobile carrier's normal fees for internet services and SMS.  If you change mobile numbers and are using mobile services to access your RSVPhere account, please notify us with your new number.

Passwords: You are responsible for keeping the password to your home profile confidential and agree to contact RSVPhere should you suspect any foreign activity on your account.  You are solely responsible for use of your account. 

Disputes: You are responsible for any disputes with other members or guests that arise as a result of the use of RSVPhere.  We do not have an obligation to get involved with disputes, but do have the right to do so.  Your use of the site confirms your agreement that the laws of the State of Virginia will govern the terms of this policy and it is in Virginia that a dispute/claim between a user and us would be resolved.

Fee Rules: You recognize that RSVPhere.com has the right to change any applicable fees.  You agree not to accept payment or valuables from third party companies for performing commercial duties or advisements through your event pages.

Terms of Sale:   As you make purchases through our site you agree to the terms of Sale of the company you are purchasing from.  Please make sure to review those terms before you complete your purchase.

Content: RSVPhere may use materials you post on the site, but only within the RSVPhere site and we do not claim ownership of them.  Materials you post on the site operate under the liabilities associated with those particular materials.  You may not post videos or photos of another person without their permission.  Once an account is terminated, the use of those materials would also be terminated.  RSVPhere has limited license to use such materials and you agree that the materials you use are not conflicting with any copyright or any other contractual agreement that would be breached by such use.  You agree that the content is royalty free and are responsible for any fees and royalties related to content you post or posted through you.  All content posted by you is your sole responsibility and by using it you confirm that you own the right to do so.   If you choose to make your personal information available to the public, you do so at your own risk.

RSVPhere web content is protected by copyright, pending patent applications with all rights reserved, and as a user you are granted limited license in connection with our services.  These terms govern your use of the content of our site which is not to be sold, copied, modified, distributed or published except by the terms set forth in this agreement.

Unless given your permission, RSVPhere.com will not share personally identifiable information with other sites.  We may share your information with Affiliated Sites for a good business reason as well as business partners in the case of being able to provide you with targeted advertising.  This helps us to provide advertising that is relevant to you.  If you make a request that requires RSVPhere to share your personal information, you will be informed.  We may, on occasion, alert you to the uses of terms of information collected if it varies from this Privacy Policy. 

We may also use your contact information to provide you with notifications and promotional materials if you have requested them from us.  We use your information to help us manage and provide you customer support.  We share your personal information with authorized service providers that are performing duties for our site.  Examples of such services would be website support, filling purchase orders, processing payments, contest support, and delivering goods.  Also, your requests to make reservations may result in us sharing your personal information with hotels or services for the purpose of your reservation.  If reservation partners are contacting you after you make reservations with them through our site, and you wish not to be contacted by the reservation partners, please contact them directly and let them know.

Data that we collect includes your browser information, IP address, and data that helps us to enhance our site.   We use cookies (bits of info placed on your computer) to help with this tracking process.  As a user you may store information on your personal homepage at your discretion.  Any personal information you provide through your RSVP card to your guests is also at your own discretion. Third party links and advertisements may also have cookies and pixels (used to record number and types of views on a page).  In some cases RSVPhere may allow the use of pixels to gather data for advertising and usage purposes.  RSVPhere does not control cookies from third party sites and would advise users to read through privacy policies of such sites.  RSVPhere is not responsible for the privacy policies of third party links or advertisements.  You can program your computer to alert you for cookies.

Advertising: Part of the advertising on RSVPhere may be from third party internet advertising companies which will also use cookies to collect and track movement to their ads.  Please read the privacy policies associated with such sites as they differ from this one.  We encourage you to be aware of third party companies where you provide personal information.  If a third party provides personal information to RSVPhere, the information will also operate under the terms of this Terms of Agreement/Privacy Policy.  RSVPhere.com may be used for promotional purposes; however we reserve the right to remove unauthorized direct commercial advertising and solicitation.

Security:  We want you to feel secure using our website.  RSVPhere uses procedures and a number of technologies to ensure that personal information as well as any other data collected by us are safe from malicious use including unauthorized use and theft.  We use firewalls and encryption to help with the security of your information and transactions. The information you post on your event pages will be viewable to those you give access to, however RSVPhere does not have control over those individuals, and we are not responsible for what they do with the information you provide to them.  Although we make appropriate efforts to ensure the security of you information, we do not promise that your communication will always remain secure because no system can be completely secure.

Indemnity: Under no circumstances is RSVPhere responsible for any loss or damage resulting from the use of RSVPhere services, online or offline.  This includes personal injury or death.  You agree to indemnify and hold RSVPhere and its affiliates, contractors, and employees harmless for any damages/loss that you incur or that indirectly affects/damages another through your use of our services and is in violation/breach of this policy.  This includes loss of profits, data, or other intangibles.  We are not responsible for any unlawful activity by other parties to you through the RSVPhere site.  This includes harassment, abuse, and harmful conduct as well as infringement on your rights by others through our site.

Limitation on Liability: Under no circumstances is RSVPhere liable to you or any third party for any damages, direct or indirect that comes from your use of RSVPhere, even if we have been told of the possibilities of these damages.  RSVPhere's liability to you no matter the action is at all times limited to any fees paid by you to RSVPhere during the course of your membership.  We reserve the right to share any and all personal or applicable information to the court system to defend against legal claims.
